ARTICLE 1 - Scope of application

These General Conditions of Sale (hereinafter "GTC") apply, without restriction or reservation, to all sales concluded by the Seller to non-professional buyers (hereinafter "the Customers" or "the Customer"), who wish to purchase the products offered for sale (hereinafter "the Products") by the Seller on the website www.birdcagehats.com .

The products offered for sale on the site are the following:

  • Women's hats and hair accessories, exclusively new.

The main characteristics of the Products, including specifications, illustrations and indications on dimensions or capacities, are presented on the website www.birdcagehats.com , and the Customer is required to read them before placing an order.

The selection and purchase of a Product are the sole responsibility of the Customer.

Product offers are valid within the limits of available stocks, as specified at the time of ordering.

These GTC are accessible at any time on the website www.birdcagehats.com and prevail over any other document.

The Customer declares that he has read the GTC and accepts them by selecting the appropriate box before proceeding with the online order at www.birdcagehats.com .

Unless proven otherwise, the data recorded in the Seller's computer system constitute proof of all transactions concluded with the Customer.

The Products presented on the website www.birdcagehats.com are offered for sale in the following territories:

Europe .

In the case of orders placed from a country other than metropolitan France, the Customer is considered the importer of the Products.

For all Products shipped outside the European Union and the French overseas departments and territories (DOM-TOM), the price will automatically be calculated net of taxes on the invoice.

Any customs duties or other local taxes, import duties, or state fees may be applicable. These charges are the sole responsibility of the Customer.

ARTICLE 2 - Prices

The Products are supplied at the prices in force indicated on the website www.birdcagehats.com at the time the order is registered by the Seller.

Prices are expressed in Euros , both excluding and including VAT .

Prices take into account any discounts granted by the Seller on the website www.birdcagehats.com .

These prices are fixed and cannot be changed during the indicated validity period, but the Seller reserves the right to change them at any time outside of this period.

Prices do not include handling, shipping, transportation and delivery costs, which are invoiced separately.

The total purchase amount, including these charges, will be communicated to the Customer before confirming the order.

An invoice is issued by the Seller and delivered to the Customer upon delivery of the ordered Products.

ARTICLE 3 - Orders

The Customer must select the Products he wishes to purchase on the website www.birdcagehats.com , following this procedure:

  1. The Customer chooses a Product and adds it to the cart, with the option of modifying or deleting it before confirming the order.
  2. After confirming the order and accepting the GTC, the Customer enters his/her personal data or logs into his/her account.
  3. The Customer chooses the shipping method.
  4. Once all the information has been validated, the order is final and payment is required.

Product offers are valid while stocks last.

The sale will be considered valid only after full payment of the price.

The Customer is required to verify the accuracy of the order and to immediately report any errors.

Any order placed on the website www.birdcagehats.com constitutes a distance contract between the Customer and the Seller.

The Seller reserves the right to cancel or refuse any order from a Customer with whom there is a dispute relating to a payment not previously made.

The Customer can monitor the status of his order on the site.

ARTICLE 4 - Payment Terms

The price can be paid via secure payment in the following ways:

  • Credit card
  • Bank transfer (the Seller's bank details will be communicated at the time of ordering)

Payment must be made in full at the time of ordering .

Payment data is encrypted according to the protocol defined by the payment provider used for banking transactions on www.birdcagehats.com .

Payment will be considered final only after the sums due to the Seller have actually been credited.

The Seller will not be obliged to deliver the Products ordered if the Customer has not made full payment according to the conditions indicated above.

ARTICLE 5 - Deliveries

The Products ordered by the Customer will be delivered in metropolitan France or in the following territories:

Europe .

Deliveries take place within 15 working days to the address provided by the Customer at the time of ordering.

If the Products are not delivered within 15 working days of the expected date , and for reasons not attributable to force majeure or the Customer, the latter may request cancellation of the sale and reimbursement of the amount paid.

Shipping costs are the responsibility of the Customer, unless otherwise indicated.

The Customer must check the condition of the Products upon delivery and report any problems within 5 working days by email, attaching photographic evidence.

ARTICLE 6 - Transfer of ownership

The transfer of ownership of the Products occurs only after full payment of the price.

ARTICLE 7 - Right of withdrawal

In accordance with current legal provisions, the Customer has a period of 14 days from receipt of the Product to exercise the right of withdrawal without having to justify reasons or pay penalties, with the exception of return costs , which remain the responsibility of the Customer.

The right of withdrawal can be exercised before the deadline by sending a clear and unequivocal declaration via:

The Products must be returned within 14 days of sending the withdrawal notice, in their original condition, complete with packaging and accessories, so that they can be sold again.

Return costs are the responsibility of the Customer .

The refund will be made within 14 days of receiving the returned Products, using the same payment method chosen by the Customer at the time of purchase.

The Seller may postpone the refund until receipt of the Products or until proof of their shipment, whichever occurs first.

Exceptions to the right of withdrawal

In accordance with Article L221-28 of the French Consumer Code , the right of withdrawal does not apply in the following cases:

  • Products made to measure or customized upon customer request.
  • Sealed products that, once opened after delivery, cannot be returned for hygiene or health protection reasons.
ARTICLE 8 - Seller's Responsibilities - Guarantees

The products sold on the website www.birdcagehats.com comply with the regulations in force in France and automatically benefit from the following legal guarantees:

The Seller is responsible for the conformity of the Product sold.

The Customer can request the free repair or replacement of the Product if it presents a lack of conformity within 2 years of delivery .

If repair or replacement is impossible, the Customer can obtain a refund.

Legal guarantee against hidden defects

(Articles 1641 et seq. of the French Civil Code)

If the Product has a hidden defect that makes it unusable or compromises its use, the Customer may request the resolution of the sale or a reduction in the price .

To assert one of these guarantees, the Customer must contact the Seller by email or post at the contact details indicated in Article 1 .

ARTICLE 9 - Protection of personal data

In compliance with the General Data Protection Regulation (GDPR - EU Regulation 2016/679) , the Seller collects only the data strictly necessary for order management and customer service.

The personal data collected are as follows:

  • Delivery and billing address
  • E-mail address
  • Telephone number
  • Payment data (securely handled by payment service providers)

This data is retained for the time necessary to manage orders and in compliance with legal and tax obligations.

The Customer has the right to:

  • Access, rectify, or delete your personal data.
  • Object to the processing of your data or request its limitation.
  • Request portability of your data.

ARTICLE 10 - Intellectual property

ARTICLE 11 - Force majeure

The Seller shall not be held liable for failure to execute the order in the event of force majeure events, including:

  • Natural disasters (floods, earthquakes, fires)
  • Wars, terrorist acts
  • Strikes, roadblocks or transport disruptions
  • Failures in computer or telecommunication systems beyond the Seller's control

If the force majeure event persists for more than 30 days , either party may cancel the order without penalty.

ARTICLE 12 - Applicable law - Disputes

These General Conditions of Sale and the transactions relating to them are governed by French law .

If no solution is found, the Customer can:

  • Contact a consumer mediator free of charge , in accordance with the provisions of the French Consumer Code.
  • Take legal action before the competent French courts.
